Mathews Archery, Inc. and its affiliates (collectively, “Mathews,” or “we,” “our,” or “us”) respect the privacy of our users. Our privacy policy (“Privacy Policy”) explains what personal information is collected, how it is used, and your data rights in connection with our websites, related mobile applications and services (collectively, “Services”).

How this Privacy Policy Applies

This Privacy Policy applies to information collected through websites and Services owned and operated by Mathews. This Privacy Policy also applies to information collected through any other online property or mobile application owned or operated by Mathews (“App”), which links to or references this Privacy Policy. This Privacy Policy does not apply to any other websites or services, even if links to those websites or services are provided on any Mathews websites or services. What Data do we collect?

Personal and Sensitive Information
Personal Information is data that directly or indirectly identifies you. We collect personal information that you voluntarily submit when you register for your Mathews account and/or purchase any products or merchandise through our online store. This includes, for example, information such as your name, date of birth, phone number, postal address, email address. This also includes the profile picture that you may choose to upload to your account, and which may identify you.

When you make a payment through any of our Services, you provide payment information such as your credit or debit card or other payment details. We use Payment Card Industry (PCI) compliant third-party payment services and we do not store your credit card information.

The information we do store is used to understand your needs, provide you with a better service, and for the following reasons:

  • Internal record keeping.
  • Improve our products and services.
  • Customize the website according to your interests.
  • Periodically send promotional emails about new products, special offers or other information which we think you may find interesting.
  • We may also contact you for market research purposes.


Technical Information
When you use and interact with our Services, we may collect certain types of technical information to enhance the user experience. Such information can include your IP address, the time you access the website, the pages you access on the website, the browser you are using, and information about the device you use when you access our website. D. Commercial information. Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
E. Biometric information. Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.
F. Internet or other similar network activity. Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.
G. Geolocation data. Physical location or movements.
H. Sensory data. Audio, electronic, visual, thermal, olfactory, or similar information.
I. Inferences drawn from other personal information. Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

WHEN AND HOW WE SHARE YOUR DATA

We do not sell your data for monetary value.
We may disclose, share, or transfer your personal data for the reasons below, and to other parties to the extent permitted or required by law.

Internal.
By using our website, you acknowledge and agree that your personal data will be collected by Mathews and that we may share your personal data with groups affiliated with or used by Mathews Archery, Inc. to provide the Services. This may include billing and delivery of your purchases, processing transactions, and development and maintenance of digital services.

Service providers and other authorized third parties.
We may transfer your personal data to authorized third parties who process personal data on behalf of Mathews for the purposes described in this Privacy Policy, such as technical, logistics, e-commerce, marketing, and other services. This includes the following authorized third parties:

Applicable Laws.
We may disclose and otherwise process your personal data in accordance with applicable laws to defend Mathews’ legitimate interests, for example, in civil or criminal legal proceedings. We may also share information with governmental agencies or other entities when: (1) permitted or required by law; (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; or (3) investigating fraud which has already taken place.

Mergers, Acquisitions, Business Transactions and Transfers. 
We may disclose and/or transfer your personal data to relevant parties such as prospective or actual purchasers and their advisers in connection with mergers, acquisitions, sales, reorganizations, or other transactions or transfers or changes of control involving Mathews and/or its group companies, services, applications, digital services, or businesses.

HOW TO OPT OUT

You may opt out from marketing e-mails by following the links provided at the bottom of each email communication (typically provided via “unsubscribe” link) or by contacting customer service. See “Privacy Contact Information” below for more information. All other forms of direct marketing can be opted out by contacting customer service.

If you choose to opt out, we may still send you non-marketing e-mails, such as service notifications or other information or, if you are a business customer, we may send business related information. You may also opt-out from any SMS based direct marketing by replying “stop” to the text message.

YOUR RIGHTS TO YOUR DATA

Edit your data.
Each customer has the right to edit or change all personal data collected and stored by Mathews. Our Services allow you to edit your information instead of contacting customer service. Simply locate your profile or account on the website or App to edit your data. You must provide true, accurate, and current information about yourself, including, but not limited to, your name, date of birth, and email address. For more information, see our Terms of Use.

Remove your data.
Customers also have the right to be forgotten, meaning to have their data removed from the online store. To remove your data, simply visit the “My Account” dropdown link in the menu, scroll down, and click on the “Delete My Personal Info” link. Alternatively, you can contact customer service to request that they delete it. This will be done within 15 business days.

PRIVACY OF CHILDREN

We do not knowingly collect, maintain, or use Personal Information from anyone under thirteen (13) years of age or under the age required in your jurisdiction to use our Services (“Minimum Age”). Our website and related services are in no part directed at or intended for use by any individual under the Minimum Age.

If you learn that your child has provided us with Personal Information without your consent, you may notify us at customersupport@mathewsinc.com and request that the information be deleted. If we learn that we have collected any Personal Information from an individual under the Minimum Age, we will promptly take steps to delete the account and data.

INFORMATION RETENTION

We keep the categories of Data described above for as long as is necessary for the purposes described in this Notice or otherwise authorized by law. This generally means we will retain your personal information as long as one of the following applies:

  • Your personal information is necessary to satisfy the purpose for which we collected the information.
  • Your personal data is required to protect or defend our rights or property or to comply with applicable laws that limit actions in a particular case.

THE GENERAL DATA PROTECTION REGULATION

Your Rights Under the GDPR

Under the General Data Protection Regulation (“GDPR”), Mathews is a data controller and data processor for the information we collect from you. If you are are covered by the GDPR, you have the right to access personal data we hold about you and to ask that your personal data be corrected, updated, or deleted.

Note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Services), or otherwise to pursue our legitimate business interests. Be aware that your information will be transferred outside of Europe, including to the United States.

Note that you have specific rights under the GDPR, as follows:

  • You may withdraw your previously provided consent to the processing of your personal data at any time.
  • You may object to the processing of your personal data if it is being carried out for a purpose for which you have previously provided consent.
  • You may access your specific personal data in the possession of the Services, obtain disclosure regarding certain aspects of the processing, and obtain a copy of your personal data subject to processing.
  • You may seek to have your personal data updated or corrected.
  • Under certain circumstances, you may restrict the processing of your personal data, in which case we will refrain from any processing activity other than storage.

What is your right to access specific information under the GDPR?

You have the right to request that the Services disclose certain information to you about our collection and use of your personal data over the past 12 months. Once we receive and confirm a verifiable request from you, we will disclose to you:

We will endeavor to respond to your request as promptly as possible but in any event in no more than 30 days from the receipt of your verifiable request.

Only you may request to exercise your rights or those of your minor child, and your request must be verifiable. Your verifiable consumer request must: (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal data or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request if we cannot verify your identity or authority to make the request and confirm the personal data relates to you. We will only use personal data provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request and for no other reason. Though you do not need to create an account to make a verifiable consumer request, we consider requests made through your password-protected account sufficiently verified when the request relates to personal data associated with that specific account. If you have an account with us, we will deliver our written response to the email address associated with your account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

For requests to transfer your personal data to another entity, we will provide your personal data in a format of our choosing that is readily useable and should allow you to transmit the information without hindrance. Any disclosures we provide will only cover the twelve (12) month period preceding our receipt of your verifiable consumer request. If applicable, our response will provide the reasons we cannot comply with your request.

We will not charge you a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why and provide a cost estimate before completing your request.

We will not discriminate against you for exercising your rights.

We will not discriminate against you for exercising any of your privacy rights. Unless permitted under applicable laws, solely due to the exercise of your rights hereunder, we will not:

  • deny you goods or services;
  • charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • provide you a different level or quality of goods or services; or
  • suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal data’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. We currently provide no such financial incentives.
